The situation

A commercial lender financed an individual’s vehicle purchase. When payments stopped, the lender referred the account for recovery in Burnaby, British Columbia.

Our approach

Precision Paralegal Services filed a civil claim against the borrower and completed personal service.

When the borrower did not respond, we obtained a default judgment.

We pursued a garnishing order after judgment, prepared the supporting affidavit and confirmed delivery to the garnishee.

The outcome

Default judgment was obtained and garnishment steps were completed through confirmed delivery to the garnishee. Receipt of recovered funds is not confirmed in this case study.

What this case illustrates

Obtaining judgment and collecting payment are separate stages of a debt file. This matter illustrates the work involved in progressing from default judgment to a garnishing order and confirmed delivery to the garnishee.
