Full Recovery After a Dealer Sold a Trade-In Subject to a Security Interest

The situation

A vehicle financing client held a registered security interest in a truck. A dealership accepted the truck as a trade-in and sold it without paying out or discharging the security. The lender was left unpaid and without the collateral.

Our approach

Precision Paralegal Services confirmed the dealership’s corporate registration and sent a demand for payment.

When payment did not follow, we filed a claim in British Columbia and served the dealership in connection with the Vancouver matter.

The dealership paid the account in full by cheque. We then filed a notice of withdrawal.

The outcome

The account was paid in full and the court claim was withdrawn.
